Polygamy is a punishable act under the Indian Penal Code. The IPC provides for a punishment of up to 7 years alongwith fine if found guilty of a polygamous marriage. Muslim law does allow polygamy however, if one is a public servant then depending upon the type of department a person is working in, there are service or conduct rules which prohibit the government servant from polygamy. These service rules/conduct rules put a bar on a subsequent marriage. However, these rules do not provide for a punishment resulting in jail term but rather they provide punishments in the form of dismissal from service etc. the type of punishment prescribed would depend upon the type of government service a person is employed in. (Depends from state to state and also on the fact that whether the person is a state govt employee or a central govt employee).

By a recent judgment of Supreme Court passed in 2015, you may challenge bigamy. It is irrelevant whether the the person is government servant or not. However, you may still file a case before the Courts.
