Promissory note debt money repayment issue
24-Sep-2023 (In Civil Law)
In District Civil court I have lost the case and the petioner got the final judgement which declared that I have to repay the borrowed amount. But is been 3 years after final judgement the petitioner has not filed an Execution petititon. Now i am planning to repay the borrowed amount as per the judgement. Please advice on how to repay this money. Should we file a new petition or go to lok adalat to pay this money. Please advice the legal way since the petitioner is demanding more money than the judgement amount
you need not worry in this matter. There is no need to pay excess amount than decreed. Firstly calculate the amount to be paid the decree holder as per the decree.. i.e., the decreed amount+ suit costs as mentioned in the decree+interest (@ the percentage as mentioned in decree) on the principal amount till the date of decree and subsequent interest till today (@ the percentage as mentioned in decree) on the principal amount and deposit the same into the particular Court and there the matter ends.
you can also deposit the amount in a particular bank (in view of interest is going on) on your name and you can clear the same when the DHr demands you or if he files execution petition with in the remaining 9 yesrs because, the decree will be in force for 12 years only.
