Procedure for daughter's share in demised father's property

20-Oct-2023 (In Civil Law)
I am 35 years old. My father died (hindu religion). After his death we are 6 members including my mom in legal heir. They are not willing to give the equal share to me. Because I am a female. If you are not handover your share to us, we directly pay your share amount in the court. You go to court and you receive it. Is this possible? Without or with my knowledge will they pay my share amount in court?

if the female who is got married before 1985 is not able to ask the share on the property which is divided if it is not divided means who is the legal heir is having the equal rights, if they are sold the property with out your knowledge is offence so you can sue against them without your knowledge and the signature nobody can sale the property.

Hello madam, You are equally placed in par with any male member of your family. You cannot be dispossessed of your share without your consent as you are entitled to 1/6th share in the property. If the dispute is brought to court or suit for partition is filed, it is open to you to contest and either opt your share or sell your share and receive the amount proportionate to your share bit it has to happen with your consent. If the partition is not brought to your knowledge you can always challenge it through court.

Dear client, 1. You can approach court and file a partition suit to get a equal share. 2. Also get a stay from the court to not to sell your share to anyone. 3. If they approach court, then also you will get equal share only. You can set an appointment for consultation on phone/chat/email with me regard to your case.
