Pet bought and died in 4 hours

I have bought a golden retriever (40 days old) and he died within 4 hours, after blood report it was found that he was suffering from Canine Distemper disease.Will this be considered under fraud case as the it was delivered to Noida and seller seems from delhi.
yes of course you have legal remedy as you mention your query first of all the legal presumption is the buyer must be aware but as per your detail you first of all collect the medical report of your pet that he was suffering from canine distemper disease after that send him a legal notice and claim your money with compensation in the proper court.
