payment related issue raised by employer
29-Oct-2023 (In Civil Law)
A notice has been served by a lawyer on behalf of the employer. The only signatory of the notice is of the lawyer and not the employer, does this make it a valid notice legally?
A lawyer sends the notice on behalf of the client. As a lawyer he is authorized to sign and send notices on behalf of the person who gives an authority to represent him, therefore therefore a notice sent by your employer through a lawyer and signed by a lawyer is legally valid.
As the term legal notice itself is self explanatory that a notice is sent to somebody to inform him about his legal obligations therefore a notice is nothing but an information given to someone so as to make him aware about his legal duty. Not responding to a legal notice is of course not an admission but responding to a legal notice can of course avoid further litigations.
Yes, it is legally required and ideal to respond to a legal notice in most of the cases which further depends upon what type of notice it is and under which act, concerning which matter.
In most of the cases, courts have considered that the party should be booked for the charges against him under the admission of guilt by not serving a proper reply of notice.

yes it's a valid notice. at the start of the notice every lawyer writes on behalf of my client ., no notice needs to be signed by the client. it is totally acceptable notice. infact if you refute the claims of the notice you need to reply to the notice immediately.
