Pawn broker jewel and cheating Case

Hi Sir/Madam, We have given jewels and took money from a pawn broker near our home who we know for 10 years. CASE : On september we have paid nearly 2.3 lakhs to him to get the jewels back. He still delaying and by november he has vacated his shop and house ,moved to rajasthan. PROOF : He has given me blank cheque and also in white paper he has mentioned details about jewels and moneyand placed his shop seal in it. STEPS TAKEN SO FAR: I have given complaint about him to neat station. Did'nt get CSR copy. YOUR ADVICES PLEASE : shall i procede with cheque bounce or what is the way get money from him? Thanks in advance

Section 138 of the Negotiable instruments acts 1881 deals with the issue of the cheque bouncing. The said act describes as to what is the procedure which is to be followed when the check is bounced and the person in whose favor the check was issued wants to file a case in the court of law

yes you can file cheque bounce case under 138 of NI act. before that you must know his residence address. if any property his having in your area or you know were he his having property then you may file civil suit under recovery of money. after getting decree in your favour then you file EP for attachment of property.
