Not giving admission to child in nursery school without any specific

02-Apr-2025 (In Civil Law)
My child was in playschool, and now he will be moving to nursery. Previously, my child used to say that the teacher beat him up in school, and we had a normal conversation with the school principal. However, now they are saying that because we give them a lot of feedback, they believe that we think they do not take care of our child or beat our child. Therefore, they have informed us that they will not be able to give admission to our child.can I file an FRI or any legal action against him?

It's advisable for you to first of all rather than going legally you should serve them a legal notice and in that notice you can write either stop all these harassment or face legal action which will be at your own risk. After that if they fails to give you a satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction.

Yes, school is being unreasonable here and they have no right to refuse from getting admission therefore you can approach the concerned High Court for passing appropriate writ against the school and allow you to study in the school without being prejudiced to your child.

Yes. Without any doubt legal action can be initiated and should be initiated against such school management. Filing an FIR is an option but it's better to save the child's future and secure his admission first.

Yes a notice can be send to them and they can be asked to give you in writing the reason for refusing admission to your child. Also if it is true that they beat your child then action can be taken against the school authorities

You may proceed with a formal complaint against the teacher and the school through the principal highlighting that your child was subjected to mental and physical harassment by the authorities. Denying admission merely on the basis of your feedback and not backing up the reason with substantial arguments can be a ground of writing a legal notice and thereafter, proceeding with further legal actions.
