Noise disturbance due to ground floor parking below the balcony.

19-Dec-2025 (In Civil Law)
There's a verandah kind of space outside my living/bedroom room in a ground floor flat where all members are parking their motor cycles. i.e common area on ground floor below the balcony of first floor. Due to this ,there's lot of noise disturbance  every time a member pulls out or park the motor cycles multiple time in a day. This is an old building constructed back in 1980's with no designated parking  assigned in the plan & space available behind the building is not being utilized for parking

Parking in a common area causing continuous noise amounts to nuisance. The society/association is bound to regulate use of common areas reasonably. You may seek written directions to shift parking, rely on bye-laws, and if unresolved, approach civil court for injunction and quiet enjoyment of property.

Parking of vehicles in a common area causing continuous noise can amount to nuisance. Even if the area is a common space, it cannot be used in a manner that interferes with peaceful enjoyment of a flat. You may first raise a written complaint to the society/managing committee seeking regulation or relocation of two-wheeler parking to the unused rear space. If unresolved, a legal notice can be issued, and you may approach the Civil Court for injunction or the local municipal authority for misuse of common areas. Continuous disturbance is legally actionable.
