NOC for FSSAI not issued by Society

I stay in Mumbai, the apartment is in my father's name. I have started a LLP company registered on this apartment. I need NOC from society for applying FSSAI & I have already given declaration to Society that all Company works will be carried outside the Society. My father has also given a letter stating that a company is registered which will be used only for correspondence purpose. society is reluctant to give NOC. Also there are no pending dues. What legal action can be taken
In Maharashtra, a housing society cannot arbitrarily refuse NOC if there is no commercial activity and no dues. Registration of an LLP at the flat address for correspondence only is permissible. You may first issue a legal notice to the society citing Model Bye-laws, stating no nuisance or violation. If refusal continues, you can file a complaint before the Deputy Registrar/Co-operative Court for deficiency of service and arbitrary action, and also seek directions to issue NOC. Courts have held societies cannot restrict lawful use of premises when ownership consent and declarations are on record.

Issuing NOC only for statutory/registered address will not amount to sub-letting if no possession, use or access is given. NOC must be limited, revocable, non-transferable, creating no third-party rights, and L&L must expressly prohibit sub-letting.
