Need help to solve apartment Insurance issue, as it has some encroachm

My apartment has 700 flats , out of which 70 flats have made change to their flat, illegally extended balcony. Due to this ,we are unable to claim insurance for apartment as they have built illegally. nIn this case , as the building needs renovation and we do not have sufficient funds, now we plan to collect funds from all. Can we impose fine to the illegal encroachers and ask them to pay extra for the construction from apartment owners association side, if yes then how much % can we divide

First of all, how did the apartment owners association permit those seventy owners to make extension illegally. Did the apartment owners association send notice to those owners asking them to remove illegal construction?
