My share in my deceased mother's property who died without any will.

My parents had a property in their joint name. Last year my mother died without any will. Now my father wants to sell the property without giving any share to me. We are two brothers and one married sister. So, what will be my share in the property and how to get it? Pls help me.

He can sell only half of the property which belongs to him. Since your mother died intestate, her one-half share in the joint property she was holding with your father has fallen upon you, your brother and her sister.

Hello The parents had the property in their name. If that was a self acquired property then your father can give it away to anybody he wants as far as his share is concerned. But as far as your mothers share is concerned....you all have a share in it. Even your father. He cannot sell the whole property as it would be illegal. Regards
