My neighbour and I were building simultaneously. He created a ventilat

22-May-2026 (In Civil Law)
My neighbour and I were building simultaneously. He created a ventilation shaft in his house, built walls on ground floor both sides, but did NOT continue the wall upward on my side. From first floor up, only MY wall encloses his ventilation shaft. Now my wall is exposed to weather. He is doing plaster work but refuses to plaster my exposed wall saying "it's your wall." I may make a window there since it's my wall and my plot.

This is a classic party wall / common boundary dispute. Since both houses were built simultaneously and the ventilation shaft is enclosed by your wall from the first floor, the neighbor has a responsibility to maintain the common structure properly

Since the shaft is enclosed only by your wall from first floor onward, your neighbour cannot use it without protecting your wall from damage/weather. You may seek plaster cost or injunction. Window rights depend on local bye-laws.
