Mutual divorce - Hindu - physical presence in court necessary ?
14-Apr-2023 (In Civil Law)
I have to go abroad for work for 1 year, is it necessary to appear in person for mutual divorce filed in India
Query perused. Yes for divorce by way of mutual consent the parties have to appear in person on both 1st motion and 2nd motion for recording the statements. However there is a reconciliation period of 6 months prescribed during 1st and 2ns motion. The same can be waived off by moving an application for waiver at the discretion of the court. Personal appearance is although required in each and every case. One can pray through his/her advocate for exemption from personal appearance on the grounds mentioned above. Courts usually ask for a personal appearance in the matters which are to be of much importance to the litigants.
