Mistake In Summons And Legal Notice

19-Aug-2023 (In Civil Law)
I have received a legal notice from a lawyer and summons from court for partition of family property but in both these documents the opponent(my brother) has mentioned that I got married when my father was alive where in reality I am not married so now the question is can I file a defamation case against my brother and his uncle or is there any way that I can proceed legally against them??

sir/madam i would like to let you know whether you were married before or after the death of your father in both the cases you will get partition as soon as defamation case case goes you can file defamation case but on the above mentioned content you cannot if there are any other allegations that you need to level then you can and basing on that if any damage has occured to you, you can also claim damages in civil suit or you can just file criminal defamation case also please contact me for further details

1) They will defend that is just a mistake. 2) So far as Defamation suit concerned, the burden of proof is on you to prove that your opponent defamed your reputation before any other person or persons. Only then defamation suit will be attracted. 3)Better you defend your partition suit carefully and don't flag any unnecessary litigation without a strong point on your side, if you do so which is a waste of time and money.
