Minor passport on hold, i am divorced parent having sole custody for

SirI am a divorcee holding sole custody rights for the child. Father agreed to cooperate for passport of the child during divorce proceeding and in the divorce order same is written. But he is not at all in contact with the child till now since 2017 after divorce, nor his whereabouts are know to us. Recently i applied for child's passport renewal, but passport officers kept the passport on hold due to lack of fathers signature in the Annexure D. I explained him the reasons also, but they are asking for his consent. It has been kept on hold for a year. Can i send a legal notice to exhusband requesting to cooperate as it was mentioned in the court order?or what is the alternative i can do. Please help...

hi you could file writ petition in high court against the action of passport authorities in not renewing the passport as both the parents consent is not required under the Act and an affidavit may be enough

you have to approach competent court to grant full custody of child you that custody was already granted in divorce proceedings you pls send me copy of the same if that is the case we can directly approach high court and get an order directing passport authority to process pending request
