Matter is regarding roof rights of top floor owner.

13-Oct-2023 (In Civil Law)
I have full roof rights and I am the owner of 4th floor above parking. Will I need to take permission from other floor owners if in future 5th floor construction rule passes? Or will I need to take permission from other floor owners to sell my roof? What should I write in agreement beside roof rights to get no interference in the same....?

You will be required to take permission from all the floor owners which will be in the form of NOC. when this is done, you can take the permission from respective authorities and construct the 5 floor.

Yes, you can build another floor. Therefore,  first take permission from MCD and complete all the formalities. Then, without any permission from another floor owners may construct fifth floor. you may sell roof If have roof rights.

you don't have to take permission from other owners..If the same is specified in agreement that you have absolute roof rights in said property..otherwise you should take permission from rest of floor owners.
