Legal remedies against stay on sale of property

My mother is the owner of the property.. I recently lost my brother who left behind his wife and 7yr son..my bhabhi has taken stay from court that we cannot remove her from home n also we cannot sell the property... We want to sell the property.. How can we do it... Can my mom transfer or gift the property..

See the property belongs to your mother and she can transfer the property to anyone she wants to. However, as she is a widow and unable to maintain herself the onus will fall on you and your mother to maintain her.
