Need help on legal steps to File specific Performance Suit Against Seller. We have signed sale agreement in December-2023 qnd seller was supposed to provide legal document and noc to my bank for legal verification of loan. They kept delaying document for months and now blaming my bank for delay and asking to cancel sale agreement

okay i understand your questions so now you want to file a specifice performance suit right yes it is possible under sale agreement first you have to give a legal notice then you have to file specifice performance case first otherwise stipulated time crossed so you have to give legal notice is mandatory you shuld give then only you take a steps to court

if you have the agreement you can file a suit for specific performance of contract and also get an injunction order not to sell, mortgage or enter into any type of transaction with respect to the said property till the case is over, further you can also ask for alternative relief for refund of amount with compensation, cost and interest. hence file a suit in civil court and ask for the relief.
