Legal action against nuisance caused by neighbor

22-Jul-2023 (In Civil Law)
A tenant family has set in as my neighbour recently. A 14 year old boy is autistic in the family and has been a constant source of disturbance for me His misdemeanor henceforth is the cause of complaint, as he continually keeps making irritative noises. As I am a 12th std. student, the disturbance thus caused hampers my academocs intensely. What kind of legal actions can be taken against the family for its inability to control the child, who is otherwise innocent?

Sad to know that you are being disturbed by such a situation. When you say that the child is suffering from autism, filing a tort case against his parents may be too harsh and not generally advisable. Its better if you take the help of elderly persons in your family and/or neighbourhood to make the child's parents understand that you and/or others are getting disturbed by the noise made by their son. Also advice the child's parents to take assistance of voluntary organizations and to place their son there.

Get a legal notice delivered to the parents of the child through your lawyer. If things doesn’t get in place within the time mentioned in your notice, you can file a complaint in the court for your peace.
