Legal action against a relative occupying property

Religion Hindu My father has a registered will in his name. Property is located in UP. Property is occupied by a distant relative who is not ready vacate or negotiate giving death threats.what are the options we have. How much we have to spend on court fees.My father is 80 years old with only pension for survival.

You have not stated whether the property is Residential or agricultural and whether the same is assessed with Nagar Nigam or in the case of agricultural land in the khatauni. You have also not stated as to from which time property is in possession of the relative. Without these facts reply of your question is not possible.

File a suit in civil court of eviction which is the only way to get your property back. You can also file a complaint case in court if police is not taking any action under 156(3) and name all those who are grabbing you property
