Land Dispute Between Two Parties
09-Jun-2025 (In Civil Law)
My relative forcibly occupying my land although it is joint property and ri have separated the land with the presence of villager what should I do now
If your relative has forcibly occupied land that is joint property, even after you have separated the land with the presence of villagers, there are clear legal steps you can take to protect your rights and reclaim your share.
Physical separation in the presence of villagers is helpful as evidence, but a legal partition is the most secure way to establish individual ownership.
File a suit in civil court seeking an injunction to restrain your relative from further occupying or altering the property. The court can order your relative to vacate the land and prevent them from making any constructions
If the property has not been legally partitioned, file a suit for partition and separate possession. The court will determine each co-owner’s share and may order a physical division of the property.
If your relative has constructed or made changes, you can file a suit for declaration of title, recovery of possession, and a mandatory injunction for removal of unauthorized structures.
