24-Sep-2025 (In Civil Law)
Hi, Person A has forged our signature and filed a specific performance suit... on the alleged date of fake sale agreement I was present in office... My employer has given my attendance record in an email attachment... can I directly submit the laptop containing email attachment in court or take the print out of the email and submit along with 65b certificate!!? Thank you...

You cannot directly submit the laptop. As per Section 65B of the Evidence Act, you must take a printout of the email and attach a 65B certificate from the person in control of the system (e.g., employer or IT admin). This certificate must confirm the authenticity of the electronic record. Without it, the email will not be admissible in court. And if you want to submit the laptop as evidence the court will take your laptop and mark it as evidence and then you can't take it back till the end of proceedings.
