Issue with the i legal gate and dog

14-Mar-2023 (In Civil Law)
Hi I live in bulider floor. We have total four floor. I live on 2nd floor. The third floor owner has installed a gate without permission on common staris just in front of my gate. Also he is leaving his dog on the stairs. His dog barks whosover come to my home even sometime at night in front of our door. I asked him to remove the gate from stairs and keep his dog inside his home so he will not bark on our guest and child. I informed him you keep him inside your house but not on common stairs. I want to is it allowed to put gate on common stairs even if you live on top floor and how to sort this out

Hi, As per the little information provided by you I have understood that it is a builder floor and you live on Second floor while nuisance creater lives on Third floor and he has installed a gate which is creating hindrance as well as the dog is inviting unwanted tension. As it is a common stairs he cannot create any hindrance and secondly for barking of the dog, it is better to solve it once between yourself. If it doesn’t settle then we can send a legal notice advising him to not not create such hindrances otherwise it may cost him legal battle.

Sir, he has no right to install gate on stairs due to stairs are common place and no one has right to install gate. He should keep dog anyware but not in front of your gate. you may take legal action against him.
