Issue between two Co-operative housing society

There is an issue between our housing society and neighboring separate housing society about common drainage system which has chamber in our property. We want to repair it as its causing seepage. Other society neglecting it as they ain't getting affected by it. Is it necessary to get NOC from neighboring society for repair or we can start repair without there permission??

If the drainage line is common between the two Societies then it is mandatory to afford the expenses for the same, and if they are not getting affected as you are saying then the NOC is compulsory that you are going to make repair works of drainage line. Be legally safe on your part so that in future you will not facing any litigation from the other society.

You can send them letter , mentioning the status of the seepage and the chamber and the problem faced by your society. Send them notice within a period of 7 days twice. Also mention in the letter that as the said drainage is common for both the society, they need to share the expenses for the same.
Also you can appeal to the BMC or TMC office for the same to get the chamber repaired due to lack of cooperation from the other society annexing the letters you have sent.

Else you can carry pout the repair post you sending the letters and in case no reply is received within the time frame stated by you.
