Illegal acquisition of land and house

11-Sep-2023 (In Civil Law)
Sir, My father got house and a pice of land from his father by partition deed. My father rented that house to a person in 1992 without any agreement. He is in that house till present. In 2013 we approached him to vacate that house and property. But now, he is saying that he is from more than 18 years in that property and now that property belong to him. But, he don't have any proof for being for 18 years or rental agreement etc.. he don't have anything relating to that property. But, their lawyer is asking us "how your ancestors got this property..?" We have all documents ( demand register, revenue receipt from many years in the name of my ancestors, kataha and E-sath). But, in very beginning when they introduced first time documents for property there was "Kanisamari document". But, they are before 200 years ago documents and they are completely spoiled and we can't get it. But, we have all documents relating to before 100 to 150 years. And opposite person don't have any proof

If you have document to prove that your ancestors were the owners that may be some what OK
Are you paying the house tax jf so in whose name
Have you got khatha extract as on date if so in whose name the khatha stands
These are important for scrutiny of title
You may contact your advocate with all your documents and act according to his advise

If your father had rented out the property to any one for rent, then you would have collected rent , right ? when you stopped collecting rent and why ? Also, if you have all documents relating to before 100 to 150 years it should be sufficient to show your ownership.
