Husband file civil case how to contest..............

My husband file civil case against me mandatory injuction on same day which he received my maintananace 125 notice.. I received civil case notice but not received any copy with the notice due to somereason I couldn't present... Main problem is I am not working and husband not giving me any maintaince how to bear all travelling , other exp and lawyer exp ... Because traveling distance is 9hours in train
Ma'am, in case your husband has started legal proceedings in different state you can file a transfer petition praying for transfer of the case to your local jurisdiction. In addition to the above, add this fact in your application for grant of interm maintenance.

as per the contents u have stated for the transfer of petition one has to move an application to the supreme Court showing ur incapability to attend the matter in the other state .. then only ur petition can be transferred on to the specific place where u reside.

get this case transferred to your place and then you can litigate from there and you can claim maintaince under section 34 HMA and concurrently under 125 crpc as well. you have right under both the laws simultaneously. from the maintenance you can pay to your lawyer as well or get free legal aid from court.
