Husband died wife and kids want legal heirship of his fathers property

A father was died on 2001. The family members, mother, two sons and two daughters had filed the application for the tasildar office for their hair certificate. In the meanwhile elder son was died. The deceased son has a wife and two children. Now, who are entitled for heirs?
this is the basic thing somebody asking me in this whether the father died at 2001 then they all are got the legal hire certificate in case they are not got means they include the name of the elder brother who is deceased meanwhile as late after that they divide the property and get the another one legal hire certificate for the elder sons family they got the share of the elder sons not others

you have to clarify whether he is a Hindu or belonging to other religion. Because for Hindus we follow Hindu Succession Act and for Other religions Indian Succession Act. In case of Hindu also place is required as it differs from state to state.

Well, wife of deceased, a son, two daughters and wife and children of deceased son constitutes legal heirs of deceased father. As such each of you are entitled to 1/5th share which depends on your religion. The 1/5th share of your deceased son goes to his wife and children.

The mother, two son and two daughters are the legal heirs . Now one of the son a legal heir dies,on his demise his children and wife are the legal heir to the limited extent of the share of the deceased son's one share. Therefore widowed wife and two children are entitled to become legal heirs, along with rest of four legal heirs namely the mother, one son and two daughters
