How to transfer domestic violence case from Mumbai to Patna

Sir , My wife with her family member file case of domestic violence & dowry from mumbai but our marriage take place in Varanasi , we both are from varanasi & my wife family members still stay in Varanasi. My wife younger brother stays in mumbai & is unmarried, he hypnotise my wife and poke her to file case in mumbai so that I can get harassed. Please tell me the procedure how do I get transferred my case from mumbai to patna .. thanks

Since you want to get your domestic violence case from Mumbai to Patna, as the states are different so only Supreme Court has power to transfer the case from one state to another state. High Court has only power to transfer the cases from one district to another district within state only. You may file divorce petition if you like in Varanasi or Patna alliging that the parties to the marriage last resided together at Patna.

Sir if you want to transfer the case in other state
You I'll have to file a transfer petition in supreme court
If state transfer is required only Supreme Court is a option
In petition there must be sufficient cause

you can file an application or transfer petition in Patna high court, stating the materiel facts of the marriage as well as other situation, and along with that file a caveat application also in high court it will help you to protect your right of information related to the case. you just have to prove that your wife is not putting at Mumbai.
