How to stop Abusive neighbour in Building

06-Mar-2025 (In Civil Law)
There is a lady neighbour in our building who has been creating a ruckus for no reason for the past 3-4 months. She obstructs the entry of other neighbors, domestic helpers living in the same building and abuses people in the building without any logical reason. Whenever we try to stop her, she threatens to implicate us in false cases. We have also complained to the local police, but they said it is a personal matter. Hence, i would like to know the legal remedies available to stop her activity

No matter what the police says you can always get an NCR registered as this is a public nuisance once other neighbours are also affected. You can also file a complaint case in this regard. On civil side, one sure shot method of dealing with such people is Suit for mandatory injunction against such a person. However first discuss at length with your lawyer and devise a strategy which best suits your case.

You can send her notice informing her about your willingness to proceed unless she restrains from the uncalled actions. Further, if she does not heed to your request you can file a criminal complaint against her or can take her to the Court seeking other remedies.

If a neighbor is continuously harassing and obstructing residents, legal steps can be taken to stop such behavior. A written complaint should be filed with the police citing relevant laws related to nuisance, obstruction, and intimidation. If the police refuse to act, approaching higher authorities or filing a formal complaint with the Commissioner can be effective. For immediate relief, a petition can be filed before the local magistrate seeking restrictions on her actions. A civil suit for injunction can also be pursued to legally prevent further disturbances and claim damages for harassment. In buildings with an RWA or housing society, complaints can be made to initiate internal action. Collecting CCTV footage, witness statements, and written evidence strengthens the case. A legal notice warning of further legal consequences may deter continued misconduct. If the issue persists, maintaining records of incidents will support stronger legal steps.

You can initiate with the legal notice and if she did not stop then we can file a suit for injunction before the concerned court. Its a civil dispute that's why the police official did not take the necessary steps. So as discussed above if you require any further assistance please feel free to contact further.

You may want to consider submitting an application under Section 164 of the Bharatiya Nagarik Suraksha Sanhita, 2023. This provision empowers the Magistrate to issue orders aimed at maintaining public order, which, at the Court’s discretion, could include directing the police to register and investigate the actions of the individual in question. Please feel free to contact us to discuss the next steps.
