How to prevent the construction in a shared street

10-Oct-2023 (In Civil Law)
Hi everyone here I need suggestions to prevent the construction on a shared street. there is a small street between our home and my uncle's home. We both have given the some land to make shared street. There is a third uncle who does not have part of their land in this street but this is main way for him. Now he has built your home towards another street and he wants to use this street for his purpose/personal use.I have a window towards this street.and they will cover it by making something in this area. I have no choice .so i want to make stay in this construction. If you have better solution to prevent this construction please suggest me. or if stay is solution, please tell me the procedure for making stay on this construction

Hello, negotiating with your relatives is always the best way forward. However, if the problem still persists then filing a suit for permanent injunction along with an application seeking a temporary injunction is the most viable strategy. The process will depend upon the facts and circumstances around the property. Also, the courts decision of the matter will depend upon the facts and circumstances of the case and the evidence adduced.

Pls do let know since when street exists when you ppl contributed your share of land - chronology of events ..!!? - you may suit for permanent injunction restraint your 3rd uncle from interfering in the street apart you may have easement right qua window & ors rights eg usage of street light & air etc
