Gift deed queries and is it challengeable??
15-May-2023 (In Civil Law)
I had purchased a flat in 1980 n put second name of my son(12yrs old).ow I'm planning to gift to my daughters.to which he objects. Can he challenge such a gift deed . If he can ,how can his name be removed.i have already given another flat to him in which he's staying.pl guide as my daughters will not take the flat if challenges later.
entering the name of your son in the register sale deed of immovable property creates rites and title even though he being a minor at the time of the deed (rules of guardianship shall apply) . Your son now being major can object to any transfer of rights limited to his share. You cannot challenge his title and the same is binding on you. You can transfer your share to your daughters limited to your share in the property. The question of other property does arise as the same is not related to this transaction.however to give full comment I would need to know the entire brief.
at the time of purchase you are mention name your own and your son and now as pee your information you have given separate flag your sun and you wish to give one flat to your daughter in this situation your daughter can file suit to opuntia share in your property if you consented same it will be easy for your daughter open the same.
