Getting harrased by builder in buyback case

13-Sep-2023 (In Civil Law)
Due to evil designs of builder,i took a buyback from a builder in 2012. Builder stopped paying emis in 2014. I was living on rent and changed my residence. Bank sent notices on my previous address which i received by unknown people maybe by my previous landlord.Builder sold that flat to multiple people. Bank made me ex parte in court, and now looking to extract money from me. I came to know all this when there is a warrant issued against me. What to do

first of all you should set aside the previous round of litigation which has happened in your absence and without your knowledge. so this will bring things to square one and from this stage we can design the strategy to get you out if this.

I would have to peruse your documents to advise you. The notices sent against you by bank mentions the name of builder or not?

For further advise, i would have to peruse your documents.

Feel free to contact.

Even though your question is not very clear, If I am not wrong then in the recovery proceedings by the bank you have been made ex-parte and order has been passed in favor of the bank. Since it has now come to your knowledge, you need to get the ex-parte order set aside on the ground that you were not duly served and contest the proceedings on merits. Additionally you should initiate proceedings against the clients
