Father gave money to somebody who is not returning the same

Hello sir. My father give an amount of 350000₹ in 2012 to one person by writing on promissory note.he didn't give money till now(Nov 2017) . For the security purpose I write a promissory note with the same amount in last month with writing a date on it.whenever asked the money to the person....he is saying - I don't have money now, it will take time to pay...from 3 years he is saying that only....I have a promissory note with the signature of that person with stamp duty But not witness signature on it. What to do now ? & Can I suit a civil case on him ? Pls answer to me.

As per your conversation your father give an amount of Rs. 350000/- ₹ in 2012 to one person by writing on promissory note, base on that you can file a civil suit case against him,

Yes sir you can file a case against him in Bt he court of law for the recovery of amount along with interest and you can even file a criminal case against him station that fraud is done with me and now he is not paying

you can file a civil suit by paying appropriate court fee enquire any fixed assets of the person who is indebted to you then you can seek attachment of the property of the person who is indebted to you so firstly you can secure the money through court
