Extension of house near a disputed property

16-Jan-2023 (In Civil Law)
Hello,nI bought a first-floor flat that can be extended to include another room. This has been permitted by the RWA. The ground floor flat, however, is a disputed property and one of the claimants is not letting us construct/extend that extra space. Their flat is not even used and remains locked. Our extension will create four pillars outside their boundary and a ceiling. But they are objecting to our construction. Do they have a right to stop us from constructing that space or is there a way to resolve this issue?

When you have the necessary permissions to construct a floor on your property then you shall not be held liable for any illegal work. Your documents are very important and nothing can be done when your documents do not allow you to do so.

Hello Sir. This is Adv. Shrikant Samantara. If you are lawfully entitled gor the extension of the property, and the someone is creating a obstruction, You may file a Suit for Mandatory Injunction praying to Court to direct the Opposite Party not to create any obstruction. Feel free to contact for any further queries. Regards.
