Execution of an eviction suite.

Sir, We had let out an office for rent. The rent agreement was made with my father prior his demise. After the death of my father I wanted to evict the tenant, hence did not renew the rent agreement with him. I had filed an eviction suite in the city civil court. The decree stated that the tenant must vacate the premises in two months from the date of judgement, and the keys must be handed over to the landlady in charge. The rent amount he used to pay was not according to the market value of the area. And he has failed to pay the rent for the past 6 months , the balance amount has exceeded the advance he has deposited with me. According to the judgement provided by the court, an extension of the months has been given to the tenant, which has made me suffer a monatary loss. Can I claim for the remaining amount, along with the damages in the execution suite ? If so, how should I proceed with the same ? What is the court procedure for execution of an eviction suite ?

Yes. Please proceed by filing execution case. In that you can claim only interest on arrears of rent. In this case you cant claim damages. Once the order is passed, the tenant is bound to obey the order. Therefore if the tenant is proceeded to be there in illegal possession, then you can file a complaint also against them.

Better you contact any counsel and file an execution case immediately.
