Eligibility for OBC NCL certification

As per the Central creamy layer criterion II & III dated 08.09.1993 only the sons and daughter of following “government servants” will be treated as creamy-layer. (i) Parents, either of whom is a Group-A officer. (Direct Recruitment) (ii) Parents, both of whom are Group-B officers. (Direct Recruitment) (iii) Parents of whom only the father is a Group-B officer and he gets into Group-A at the age of 40 or earlier. I was initially Class-III employee. But I got promoted to Class-1 employee after the age of 53 Years. My annual Income is more than the limit. Am I eligible for getting OBC NCL? As per the said condition I was going to apply for NCL, but the authority not accepts my application simply they saying the income bar. Kindly help me how I proceed /whom to proceed for getting the same. Requested to give me a sample of application in your professional language for which I am able to get NCL. Necessary consulting fee will be borne by me.

Is the 1993 circular mentioned by you still holding the field? Is there any specific bar relating to income in the rules? In any case if you do not fall under the creamy layer criteria as provided in the rules, no one can stop you from obtaining a Non Creamy Layer Certificate. You may make a representation and if the same is not considered in accordance with law you may prefer a writ petition in the High Court.
