Domestic Violence Case Lodged By Wife

Me and wife has already have running contested divorce case at bandra family court. She demanded for the interim maintenance and then she disappeared and not been presented in front of court.Now after 2years of divorce case she has lodged domestic violence case at sawantwadi where she is residing currently. Can I dismiss the domestic violence case under any circumstances?

Yes, under the Domestic Violence Case, if any FIR is filed, we can get it quashed under certain grounds. If the case is filed directly in court under DV Act, 2005 , then by fighting it, we can get this case filed by your wife dismissed from Court.

you will have to file for your defenses however you cannot on your own dismiss any case against you like this. you will have to remain present before both the courts and inform one court that already a case is pending against you in the other court. if you wish to dismiss the DV case then you after informing the court of such information file an application only to pressurise the applicant that is your wife.
