Divorce and money landing issue
27-Aug-2023 (In Civil Law)
Hello sir,
My husband is about to give me divorce I am living with my parents and my husband taken money from me in cash and now he is denying to give back money as I don't have any proof that he has taken money from me only withdraw detail from my account I have.
And as he was unemployed when he has taken money from me and that money he has deposit in his own account how to file case for this.
How to take back my money or How to convince him to get back in a relationship?
1. You can take back the money or any jewellery by filing an application under Section 12 of the Domestic Violence Act, 2005.
2. File an application for maintainence under section 125 CrPC so as to ensure regular source of income for you irrespective of your present income.
3. If he files a divorce petition, you will receive a notice to appear in court. In the proceedings it can be argued that the ground for which he is seeking divorce is not vaild, therefore no ground for divorce is made out.
During the divorce proceedings, you can ask the court to send the matter for mediation.
