He can file claim in court First see on which ground or reason out from property..after go throw the papers we can say something further If you want claim you have to file claim under succession Act in the concerned court

You have not provided the full fact of the case. It is very difficult to advice you properly without discussion. Your brother have legal rights that he can avail in case others tries to curtail tmhia rights.
