Disconnection of water supply by apartment association

12-Apr-2023 (In Civil Law)
Water supply to the bathroom of my flat has been disconnected because there is a dispute between me & office-bearers of the association about the amount which they claim is due for maintenance from my flat. I am presently receiving water in my kitchen. Tried resolving the same amicably but failed. Can water supply to my bathroom be restored immediately if I file a case against the office-bearer's of the association? Can the office-bearers of the association be prosecuted for harassing me?

You need to understand the Bye - Laws of the association. What does the bye-laws of the association say? Look into it and may be you can file a police complaint against the association and its office bearers.

Except one judgement most of the judgments says that Association has no right to disconnect basic amenities like water and electricity. As such you can seek restoration of amenities illegally disconnected by the Association.
Regarding prosecution of association office bearers I need to go through by laws of the Association and about the powers of the office bearers.

The point is whether the association has disconnected the Water supply to the bathroom of your flat. Even if they have given notice, if your financial position is so bad and you are not able to pay the whole of the demand towards maintenance, court may come to your rescue. it is obligatory on the part of the user of the amenities to meet the expenses to render/supply amenities.
