Defamation, character assassination and damages under civil law ......
28-Jan-2023 (In Civil Law)
Is civil suit filed by petitioner for defamation, character assassination and damages before the Delhi High Court along with public apology by all the Defendants and monetary damages to the tune of Rs. 3 Crores maintainable? If yes, how?
Yes it is very much maintainable, viewing the social and economic goodwill, respect and fame of the person. Defamation cases are of two kind one is civil defamation in which a compensation and apology is prayed to be ordered in favour of petitioner and other one is criminal defamation where the a FIR is to be filed against the accused and he can be punished by imprisonment if proved true agaist him in the criminal court.
In India, in cases of civil defamation a person who is defamed can move either the high court or the subordinate courts and seek damages in the form of monetary compensation. We have a very popular example of Arun Jaitley v Arvind Kejriwal Defamation Suit.
Maintainability of the amount of Rs. 3 cr depends upon the reputation and goodwill of the petitioner in the society ,how much defaming affect him what kind off loss occurred because of such defaming act to the petitioner what kind of monetary loss suffererd by petitioner all facts are relevent for that after that hon'ble court decides the maintainability.
