Correction in DOB required for CBSE - Class Xth Board.

19-Sep-2025 (In Civil Law)
Dear Advocate, Greetings!! I would like to meet you to discuss a change in DOB in the records of CBSE required for my Son who has passed Class Xth from CBSE board in the year 2018. The DOB in hospital records, birth certificate issued by municipal corporation, Adhar Card, Voter ID card, PAN card are correct. As you are already aware that a court order is required to make any amendments in the CBSE record for the cases where the passing year is more than 1 year. Please suggest how to go about

Hi there, it's good that you are already aware of the procedure. To initiate it we'll file a petition in SDM court to get the changes done. In case jurisdiction is ousted by SDM court the same can be done from the regular court after making SDM a party. If you have any questions or want to proceed with the procedure, feel free to contact me.

In your case, since all official records such as birth certificate, hospital records, Aadhaar, voter ID, and PAN card reflect the correct DOB, you need to approach the competent Civil Court by filing a declaration and mandatory injunction suit seeking direction to CBSE to carry out the correction. Along with the plaint, you must annex all supporting documents showing the correct DOB. Once the decree/order is passed, the same will be submitted to CBSE Regional Office along with requisite fees for compliance.

Since your son passed Class X in 2018, the limitation period for correction with CBSE has already expired. In such cases, CBSE requires a declaratory order from the competent civil court. You will need to file a petition before the District Court under the Specific Relief Act seeking a direction to CBSE to correct the date of birth as per the official birth certificate and government IDs. Once the decree is passed, the certified copy of the judgment can be submitted to CBSE along with the application and requisite fee for correction.

you may file writ petitions before hon'ble high court or to file civil suit before the district court and file application for condonation of delay in filing cases before the appropriate court and same may be heard and order may be passed by the concern court
