Construction on suit property, case pending in court

i decided to purchase a land property and sale agreement was done on 07/07/2007, unregistered on 100/-stamp and 5lakh paid as advance signed by both parties and witnesses.remaining consideration paid later on 08/02/2012 and payment receipt was done before notary,thus complete consideration was paid before sale deed,and as seller is my "FUFI"{FATHERS SISTER},we avoided sale deed to save stamp duties..she made papers for "PARTITION DEED" and mutated my name on 7/12..later on 08/02/2013 she filed a case at S.D.O.apealing against this mutation.and declined the sale agreement and noterised payment receipt also and then i filed a case for "specific performance"in civil court on 08/08/2013. the S.D.O.set aside the previous partition deed and her name appeares on 7/12 again...meanwhile civil court ordered "TEMPERARY INJUNCTION" as was applied by me.also "LEGAL PENDANCY" mentioned on 7/12 extract.. the civil suit is pending..defendents now started constuction on suit property,wt can done?
