Complaint against neighbor constructing drain nearby the well.

I am residing in a village, our neighbors are trying to construct a drain soaked pit near our home boundary( a well is nearby).If that takes place our well gets that soaked water, moreover the well will pollute.the drain is a soaked pit without the walls and base of the pit are not constructed by cement.please give me permanent solution for this. I shall be highly thankful to you.

If the construction of the pit by your neighbors interferes with your peaceful possession of your property, file a suit for permanent injunction in the jurisdictional civil court under the limits where your property is situated and the construction work is being carried out . However, first of all, discuss with your neighbors and explain them about the problems you would face if they construct the pit and if they listens to you and abstains from constructing the pit, fine, otherwise, make a representation before the concerned municipal commissioner ( if your village comes under municipal limits) or before the concerned village panchayat officials. If there is no help from the concerned officials, then only you file the suit for permanent injunction.
