Complaint against negligent neighbor for causing soil excavation.

My house is in danger because soil excavation of neighbour . what can i do for installing a retaining wall my neighbour my house in danger .I already filed a suit in court but it takes long time to proceed .he is not willing to build a retaining wall .can i file a compliant in village to fast progress..what can I do ?

Since the suit is filed, you can seek for an injunction restraining soil excavation. Take out a commission and ascertain the extent of damages caused. Move an advance petition for above purpose if case is posted on a distant date. If at all the above is not working move to high court and get direction for speedy disposal of the suit.

You have already filed suit. Hence the proper remedy is to seek appropriate interim relief through your advocate. Certainly, your advocate is the man on the spot. He can give you the best suggestion.

U have already appointed a lawyer. Betr i consult with him first. A civil suit with an easy injunction order will do the justice for u. U can preserve ur house and plot through tat. Rest f the things court will decide. Anyhow ur plot can be preserved.

If soil excavation is being done affecting your building you could easily get an interim injunction in your suit. So also you could file a petition before the local municipal or panchayath authority which had give building permit seeking stopping of construction for violation of building rules and for nuisance

You can file a temporary mandatory injunction petition in the present suit for directing the respondent to construct retaining wall or allow me for build and also file a commission application for accessing the danger situation for convincing the court
