Clarification on eligibility for OBC-NCL if father is govt. employee

15-Nov-2023 (In Civil Law)
Hello Sir/Madam, According to the National Govt. Terms and Conditions for being eligible to OBC-NCL,it is to consider the status of the parents only and not the income, my father is a central govt employee but wasn't a direct class-1 officer recruit and hence I come under OBC-NCL layer. But my application was rejected quoting income more than termed. Please can you let me know whether I come under OBC Non- creamy layer or Creamy layer based on the details provided below : 1) My father : Central Govt Employee, he was not a direct recruit of Class-1 officer . But, presently he is a class-1 officer attained at the age later than 40 years and next year is his retirement. 2)My husband : Central Govt Class-2 officer annual pay <4.5lac . But he is SC. 3)Income of whom should be given while applying for the certificate for NCL status of OBC. 4)Validity of the OBC-NCL certificate once I receive it.

As per the stipulated conditions of the cremy layer it is be taken the present state of living and weather your family income surpasses the maximum income of the present limit is to be taken in to consideration. your question itself reveals that your father is a central government employee who is at present a class 1 employee and he would not be considered as under creamy layer. so please be advised properly
