Civil case filed regarding the property of dead spouse
09-Jan-2023 (In Civil Law)
I have a civil property case filed against me regarding the property of my dead spouse. In case of my second marriage should i mandatory inform the court once i got married or to the lawyer handling the case. Will not reporting amount to disrespect or hiding truth to the court. The property is still in his name... once remarried will i loose the claim to that property? I am the only surviving heir, no parents or kids. He has siblings who are claiming the same.
Your second marriage is no bar to your claim in your deceased husband's property. Your status will not cease after remarriage. You are entitled under Hindu succession act. You can intimate your lawyer about it.
You have every right to claim that property since you are the legal heir of your late husband. There won't be any difficulty at all about this. More over the Civil court where the matter is pending, nothing to do with your 2nd marriage. In law 2nd marriage is not invalid because you got married the other guy only after the demise of your husband. Therefore don't feel any guilt and get the property of the deceased husband.
