Cheating in Machine Rate & Late Delivery

Sir I Was a start a new business, for this required one machine. We have placed an order of a machine dated 02.04.2017 amount of Rs 555900/- and as per order conditions that machine will be delivered within 4-6 weeks, but we have received the machine on 19.06.2017 (approx 11 weeks), Because of which i had loss of Employees salary, Premises rental, discontinue the Clients' Work orders. And after some months we had knowledge from the our friends circle about Machines Price that supplier was charged the excess price to us of Rs. 1,00,000/- . So we investigated this matter, it was found that the cost of the machine realy very high cost. Now we have new quotation of rate difference of machine. So please now suggest to me that now we should be going with legal or not.

Sir for that u both parties have agreed regarding the price of machine before purchasing that..u can not sue vendor on that ground as it was well in ur knowledge before purchasing....but u can claim the damages of sending late like salary, rent incurred for the no.of months it was late and any other loss incurred by you.
