first of all you must inform the issue to the RTO of the same district from where your car is registered, then you must send a legal notice to the buyer who has purchase your car to get the car transferred immediately

Keep a signed sale agreement or delivery note clearly mentioning the buyer’s details, sale price, date of delivery, and that possession has been handed over. Ensure you have filled and signed Form 29 and Form 30 with the buyer and retain copies, along with an acknowledgment of submission to the RTO. File Form TCR (Transfer of Ownership Intimation) with the RTO at the earliest, and keep the receipt as proof that you have informed the authorities about the sale. Maintain proof of payment, such as bank transfer records or signed cash receipts, and include an indemnity clause in your agreement where the buyer accepts full responsibility for any incidents after the handover date. Also, inform your insurance company in writing about the sale so they can process the transfer of the policy. As an extra precaution, if the buyer delays the RTO transfer, send a registered letter to the RTO with all sale details, keeping a copy for yourself, which will legally protect you from post-sale liabilities.

until the vehicle’s name transfer is recorded at the RTO, you’re still legally liable for anything done with that car (accidents, challans, crimes, etc.). You need to create a paper trail showing you’ve sold it and handed over possession

Since you’ve already sold your vehicle and received payment but the RTO transfer is still pending, you should immediately protect yourself in case of accidents, traffic violations, or criminal misuse of the vehicle. Here’s what you should do and what documents you should keep/furnish: 1. Vehicle Sale Agreement – Signed by buyer & seller, with date of sale, payment details, and buyer’s liability. 2. Forms 29 & 30 – Signed by buyer & submitted to RTO; keep stamped acknowledgment. 3. Delivery Note / Possession Letter – With exact date & time of handover. 4. Buyer’s ID Proof – Aadhaar, PAN, etc. 5. Payment Proof – Bank transfer receipt, cheque copy, etc. 6. RTO Intimation Letter – Sent via Registered Post to RTO informing about sale (attach sale agreement, buyer’s ID, and Forms 29 & 30). 7. Insurance Company Intimation – Notify the insurer in writing that the vehicle is sold.
