Can we submit extra documents in writ or reference of other case

Dear Sir, My grand father purchased some residential and agriculture land in 1961 and 1968. One civil suit was filled by our neighbour in 1985 for residential land. After winning this case in 1997, our neighbour also filled a suit in revenue court for agriculture land in 1998 for declaration and possession of agriculture land. Appeal of civil suit is pending in High court with stay order since 1997. In revenue suit our advocate submitted only four- five documents & two- three months before final hearing but many documents of agriculture land was already submitted in civil suit of res. Prop.

Yes, you can submit additional documents/evidence in your suit by way of moving an application for bringing on record additional evidence. It is the discretion of the court to allow or dismiss the application. Even in a writ you can move a supplementary affidavit with additional documents to bring them on record.

You are free to file all relevant documents in your case at the initial stage, subsequent to that you need to have specific permission from the court to file additional documents. The court may ask relevancy of these documents and reason for not filing earlier, you will be permitted to file if you satisfy these conditions. However, If you file without permission it will be objected therefore it is advisable to obtain the permission of the court to file additional documents.
